Rental Terms and Policies

Production or Gear Rental Agreement

This agreement is to confirm your production or gear rental (Production) at Tahoe Production House located at 2291 Lake Tahoe Blvd South Lake Tahoe CA 96150 (Premises) and to summarize the key elements of our work together.

PRODUCTION / EQUIPMENT RENTAL: Tahoe Production House agrees to provide you with the venue for your production, the details of which are outlined on the estimate.  In exchange, you agree to pay Tahoe Production House the fee specified on the final invoice and to comply with the provisions in this agreement.

TERM: The term of this Production/Rental is shown on the estimate and continues until the Premises and/or Equipment is returned to Tahoe Production House in good condition.  Production/Renter agrees to pay the daily rental rate for each day until all items are returned in good and satisfactory condition.

IDENTIFICATION: Valid Driver’s License or Passport (photo ID) required.

BOOKING AND COLLATERAL DEPOSITS: In order to hold your booking for the studio space or gear, Tahoe Production House will charge 50% of the estimated fee through the credit card authorization upon receipt of this agreement.  The fee must be paid in full prior to the start of your production.  Tahoe Production House has no obligations under this agreement until the fee has been received in full.  For Gear Rentals — (a.) Credit Card deposit for the full replacement value of equipment, or (b.) Cash deposit for the full replacement value of equipment, and (c.) Certificate of Insurance, (d.) A credit card is required to cover any deductible and to guarantee payment.  The charge for each and every item of EQUIPMENT is the amount set forth in the estimate.  Tahoe Production House shall be entitled to immediate payment of all Rental payments at the conclusion of the Rental Term.  If leasing a web cam, there is no deposit due, only an understanding that the camera belongs to Tahoe Production House including all parts and wiring, and Tahoe Production House is responsible for maintaining the camera or replacing the camera in the event of failure.

RESERVATIONS & CANCELLATIONS: The price of rental of the equipment shall be set forth in the estimate.  Please call well in advance to reserve equipment for a future pick-up. We cannot guarantee availability on short notice. Failure to cancel your order 24 hours prior to picking up will result in a full-day rental charge or loss of your booking deposit.  Tahoe Production House reserves the right to cancel any rental for any reason at any time.

LATENESS: If you are unable to return equipment on day specified you must call Tahoe Production House to advise of the change.  Charges for rental fees will continue to accrue until equipment is returned.  If equipment is past due 72 hours without notification, your credit card authorization on file will be charged for the full amount of the equipment.

ACCEPTED CREDIT CARDS: Visa, MasterCard, American Express, Discover, Chase.   Note: We do not accept debit cards for collateral purposes.  Click here to download a Credit Card Authorization Form.  This credit card will be kept on file.  Customer agrees to allow Tahoe Production House to charge this credit card at any time for any monies due to Tahoe Production House.

CHECKS: Tahoe Production House does not accept checks for collateral deposits. Checks are accepted for payment only.

FEES: All prices are per day.  Weekend, Week and Monthly rates are available upon request. Prices are subject to change without notice. 

INSURANCE: We require insurance on all orders or credit card to cover deposit.

CERTIFICATE OF INSURANCE REQUIREMENTS:  You agree to obtain adequate insurance coverage for your Production and / or Rental containing the minimum coverage limits stated below and in which Tahoe Production House is named an additional insured (Use 2291 Lake Tahoe Blvd South Lake Tahoe, CA 96150 address)..  As a condition of your booking, you must provide Tahoe Production House with a certificate of insurance evidencing said insurance coverage (the “Certificate of Insurance”) within 24 hours of receipt of the agreement.  The Certificate of Insurance must contain the following minimum coverage limits:

  • General Aggregate: $2,000,000 (General Liability Coverage must include, explicitly, miscellaneous equipment, rented equipment, or rented and leased equipment, as well as property covered off premises.)
  • Products/Completed Ops Aggregate: $1,000,000
  • Personal & Advertising Injury: $1,000,000
  • Each Occurrence: $1,000,000
  • Fire Damage: $100,000
  • Medical Expense: $5,000

All certificates and attached forms are subject to the verification and approval process by Tahoe Production House before the equipment is released. All certificates and attached forms need to be approved 24 hrs before rental pick-up.  If you fail to procure or maintain this insurance Tahoe Production House shall have the right, but not the obligation, to procure such insurance and the cost thereof shall be repayable to Tahoe Production House in addition to all other costs.  Tahoe Production House has no obligations under this Agreement until the Certificate of Insurance has been received.

A credit card is required to cover any insurance deductible as well as to guarantee rental payment. (See credit card requirements listed above). Name on policy must match credit card. Insurance coverage must extend coverage a minimum of one week past the scheduled return dates. Insurance certificates from carriers outside the United States will not be accepted.

SAMPLE CERTIFICATE OF INSURANCE

RENTER’S INSPECTION / OWNERSHIP: Upon rental of Space or Equipment, you agree to inspect the Space / Equipment and agree that is in full working condition.  You may test the equipment at our space prior to taking possession of equipment.  The Equipment is and shall always be and remain the sole and exclusive property of Tahoe Production House and you have no rights therein except as expressly set forth herein.

LOSS OR THEFT / DAMAGE RESPONSIBILITY: Renters will be charged at the day rate on equipment that is lost or stolen until Tahoe Production House is reimbursed for the replacement cost.  Renter agrees to take full responsibility for the safety of the equipment and the return of said equipment in good operating condition to Tahoe Production House.  If equipment is returned in damaged or non working condition, the rental period will be extended by the shortest reasonable time necessary to repair the damage or to replace irreparably damaged product.  Tahoe Production House will not be responsible for any loss of data due to equipment malfunction or otherwise nor for the loss of any data that is stored on any rented media storage devises.

DATA: Renter must clear all images, content or data from the equipment prior to returning it.  If renter fails to do so, Tahoe Production House is authorized to do so, without prior notice to renter.  Renter is solely responsible for storing and safeguarding its images, content and data prior to returning the equipment.

SHIPPING: Upon Tahoe Production House approval, shipping to location may be available.  Renter is responsible for all shipping costs to and from location.  Renter is responsible but not limited to shipping costs, taxes, duties, broker fees, bonds insurance and any other associated expenses.

FOREIGN USE: You shall not remove the equipment to any foreign country without Tahoe Production House’s prior written consent.  If such consent is given, you must obtain at your own expense all proper and necessary worldwide insurance coverage in addition to the insurance requirements specified.

ACCESSIBLE AREAS: During the course of your Production, Tahoe Production House agrees to provide you with access to its studio space (“Space”), but certain areas are off limits to you and your agents, employees, independent contractors, invitees, and the licensees (guests).  By agreeing to our terms and policies, you acknowledge that you and your Guests are prohibited from entering Tahoe Production House’s private office spaces, as well as the storage area, including but not limited to the roof.  Tahoe Production House reserves the right to restrict your access to any other area of the premises during your Production.  Tahoe Production House shall have the right to enter the Space during your Production at any time for any reasonable purpose.

STUDIO PARKING TERMS: No cars may be parked in the loading dock, other than to load in or load out items.  Load in may only occur in Tahoe Production House’s Load in space and not any other marked spaces.  There is parking on the street and next door.  Violators will be towed.

CREW AND GUESTS ON SET:  Tahoe Production House can typically accommodate up to 10 guests with your production, including talent and your representatives.  If your production will be larger, advance notice must be provided to Tahoe Production House.  In the event that reasonable notice is not provided, Tahoe Production House reserves the right to bill for the additional traffic in the space.

ACCESSIBLE TIMES: You and your Guests may access the Space only during the time specified on the estimate.  If you and your Guest must access the space at any other time, prior arrangements must be made and may carry an additional charge.

SET UP, TAKE DOWN, PROPS, ETC.: Tahoe Production House agrees to provide your Production with the Space, but is not responsible for performing any additional activities associated with your Production.  Accordingly, Tahoe Production House is not responsible for 1) setting up or taking down any items or special effects associated with your Production, including but not limited to 1) building or removing walls, 2) rigging items from ceilings or grid, 3) building, painting or otherwise altering props, implements, or other property or items.  Tahoe Production House may charge an additional fee for assisting with any of these activities at Tahoe Production House’s sole discretion.

CONDITION OF PREMISES: You agree to return the Premises to the same condition that it was in prior to your Production.  You agree to pay for any and all costs and/or expenses associated with 1) the cleaning of any and all debris or substances, beyond ordinary trash, remaining on the Premises, the building, and/or any property and 2) any and all damage to the premises, the building, and/or any property which has been caused or occasioned by your production.

OUT OF THE ORDINARY CLEAN UP: You agree to pay for the cost of any additional, out of the ordinary cleaning or removal required to remove any unusual items, substances, or special effects, including but not limited to sand, water, oil, or artificial snow.  You must notify Tahoe Production House if you intend to use any such items, substances, or special effects during your Production.

STORAGE: No items may be stored at Tahoe Production House after the conclusion of your Production, unless prior arrangements are made with Tahoe Production House before the end of your Production.  Overnight storage of large items is subject to a storage fee at Tahoe Production House’s sole discretion.

MERCHANDISE PICKUP AND DROP OFF: All merchandise pickups and drop offs must be coordinated with Tahoe Production House before the end of your Production.  Pick ups and drop offs occurring outside of normal business hours, which are from 9am to 5pm Monday through Friday will carry and extra charge per hour to pay for personnel to be present at the Premises to accept or release the items.

MAIL, COURIER, AND DELIVERY FEES: You are responsible for the payment of any and all mail, courier, or delivery fees associated with your Production.  If such fees are improperly billed to Tahoe Production House, Tahoe Production House will charge you for the reimbursement using the credit card authorization on file.

ASSUMPTION OF LIABILITY: During your Production / Equipment Rental, you must take all reasonable precautions to ensure the safety of yourself, your Guests, and Tahoe Production House’s property and Premises.  You hereby assume entire responsibility and liability for any and all damage or injury of any kind or nature to persons, including but not limited to you and your Guests, and to property caused or occasioned directly or indirectly i) by you and/or your Guests, ii) by your and/or your Guests’ activities on or about the Premises, iii) resulting from the use by you and/or your Guests’ of any props, materials, tools, implements, appliances, art, works, machinery or other property, and/or iv) arising out of this agreement.

INDEMNITY: You agree to indemnify, defend, and hold harmless Tahoe Production House, its owners, members, directors, officers, employees, agents, successors, and assigns (collectively, the “Released Parties”), from and against any and all claims, actions, liability, loss, penalties, costs and expenses, including but not limited to reasonable attorneys fees, arising out of damage or injury of any kind or nature to persons, including but not limited to you and your Guests, and to property caused or occasioned directly or indirectly i) by you and/or your Guests, ii) by your and/or your Guests’ activities on or about the Premises, iii) resulting from the use by you and/or your Guests of any props, materials, tools, implements, appliances, art, works, machinery or other property, and/or iv) arising out of this agreement.  Additionally, you agree to indemnify the Released Parties, from and against all costs and expenses, including but not limited to reasonable attorneys fees, arising from or incurred by the Released Parties in defending or prosecuting any claim or suite between  you and Tahoe Production House arising out of this provision.

MISCELLANEOUS: This agreement together with the other instruments delivered in connection with it, embodies the entire understanding of our work together and supersedes any prior oral or written understanding between us regarding your Production  Any changes to this agreement must be made in writing and signed on behalf of each of us.  This agreement may be signed in one or more counterparts, each of which shall be deemed an original but all of which together shall constitute one and the same document.  If any provision of this agreement is determined by any court or competent jurisdiction to be invalid or unenforceable to any extent, the remainder of this agreement shall not be affected thereby, each provision shall be validated and enforced to the fullest extent.  Nothing in the agreement shall be construed to confer any rights, remedies, obligations, or liabilities on any person other than you, Tahoe Production House and our respective successors and assigns.  This agreement shall be governed by, construed, and interpreted in accordance with the laws of the state of California.

AUTHORIZED PERSON: The signatory of this agreement on the estimate hereby represents and warrants that he/she is an authorized person signing on your behalf.
